Shapleigh Board of Selectmen

Minutes of Meeting – Time 6:00 pm

October 12, 2021

Call to Order

Chairman Scott E. Cudworth called the meeting to order at 6:00 pm William J. Mageary and Michael J. Cote in attendance. Also in attendance was Karla B. Wilcox the Town Administrator and Joanne Holland Office Assistant.

In Attendance:

Roland Legere and Fire Chief Steve Guillemette.

Pledge of Allegiance was recited.

Approval of minutes from previous meeting: 

Selectman Michael J. Cote made a motion to approve the minutes for October 5, 2021; seconded by William J. Mageary. No further discussion. All in favor. Motion carried.

Public Comment

· Roland Legere asked the Board of Selectmen if they were planning on attending the Planning Board meeting that is being held tonight, William J. Mageary and Scott E. Cudworth stating that they would be attending. Mr. Legere asked the Board if they had spoken with the property owner regarding the solar array and if the Town of Shapleigh would be getting any compensation from the company that owns the solar array, the Town Administrator stated that the Fire Chief would be attending the Planning Board meeting to address possibly fire prevention and apparatus. Michael J. Cote asked the Town Administrator to reach out to the MMA legal department to see if they have a plan where it says yes you can have a permit but you would have to do this, etc.. The Town Administrator will contact Maine Municipal Association.

· Roland Legere also informed the Board that he had heard from Amanda Pratt , DEP Environmental Specialist and she had stated that it might be possible to remove sand from the channel between Goose Pond and Mousam Lake. Mr. Legere stated that the Town should have a maintenance plan for the run off.

Unfinished Business:

William J. Mageary wanted to send thanks to the Deputy at York County Sheriff's department for removing and winterizing the speed trailer.

William J. Mageary addressed the Board regarding Emery Mills Bridge and wanted to know if we were going to speak to the contractor that did the Acton Canal Street bridge and have him take a look at Emery Mills bridge for a recommendation on what would need to be done and the cost of it. The Town Administrator will also reach out to DOPP and DOPP and have them take a look at it and get their recommendations. Mr. Mageary asked if the guardrails had been welded yet and the Town Administrator stated that she doesn't think so but will follow up with the Road Commissioner South.

New Business:

I. Tax Abatements and Supplementals

· Abatement for Account number 938 - Was sent to the wrong owner. William J. Mageary made a motion to approve the Abatement for account number 938; seconded by Michael J. Cote. No further discussion. All in favor. Motion carried.

· Supplemental for account number 938 - Owner was taxed incorrectly. William J. Mageary made a motion to approve the Supplemental for account number 938; seconded by Michael J. Cote. No further discussion. All in favor. Motion carried.

· Supplemental for account number 2123 - Building was not taxed. William J. Mageary made a motion to approve the Supplemental for account number 2123; seconded by Michael J. Cote. No further discussion. All in favor. Motion carried.

· Abatement for account number 1952 - Property account that is tax exempt. William J. Mageary made a motion to approve the Abatement for account number 1952; seconded by Michael J. Cote. No further discussion. All in favor. Motion carried.

· Supplemental for account number 1123 - Things were omitted. William J. Mageary made a motion to approve the Supplemental for account number 1123; seconded by Michael J. Cote. No further discussion. All in favor. Motion carried.

· Abatement for account number 2546 - Acres was adjusted. William J. Mageary made a motion to approve the Abatement for account number 2546; seconded by Michael J. Cote. No further discussion. All in favor. Motion carried.

· Abatement for account number 645 - Homestead exemption was omitted. William J. Mageary made a motion to approve the Abatement for account number 645; seconded by Michael J. Cote. No further discussion. All in favor. Motion carried.

· Abatement for account number 696 - Combined 2 lots in 2021 - Updated. William J. Mageary made a motion to approve the Abatement for account number 696; seconded by Michael J. Cote. No further discussion. All in favor. Motion carried.

· Abatement for account number 2186 - The building was on the wrong tax bill. William J. Mageary made a motion to approve the Abatement for account number 2186; seconded by Michael J. Cote. No further discussion. All in favor. Motion carried.

· Abatement for account number 2914 - Adjust what improvements that had been done, percentages were incorrect. William J. Mageary made a motion to approve the Abatement for account number 2914; seconded by Michael J. Cote. No further discussion. All in favor. Motion carried.

II. Deering Ridge Road

Scott E. Cudworth had stated that some residents had inquired why the road from Emery Mills bridge to the City of Sanford line had been torn up and prepared to be repaved when there was nothing wrong with it. The Town Administrator will contact the Road Commissioner South to inquire about it.

III. Soccer Field

Scott E. Cudworth had asked if the sports field had been de-thatched yet at no cost to the Town. William J. Mageary stated he had been at the field and it had been aerated but did not look like it had been de-thatched. The Town Administrator will reach out to the company and get an update. Scott E. Cudworth and William J. Mageary held off on signing the bill for payment until resolved.

IV. Executive Session Pursuant to 1 MRSA 405(6)(a) - Personnel Matter

Motion was made by Michael J. Cote to enter into an executive session at 6:28 pm for a personnel matter pursuant to 1 MRSA 405(6)(a); seconded by William J. Mageary. No further discussion. All in favor. Motion carried. The Board of Selectmen came out of executive session at 7:10 pm.
