Shapleigh Board of Selectmen

Minutes of Meeting – Time 5:00 pm

June 1, 2021

Call to Order

Chairman Scott E. Cudworth called the meeting to order at 5:00 pm William J. Mageary and Michael J. Cote in attendance. Also in attendance was Town Administrator, Karla B Wilcox.

In Attendance:

Fire Chief Steve Guillemette, Michael Reid, Natasha Reid, Michael Sabine, aAron Sabine, Autumn Littlefield, Knathan Sabine, Ryan Sabine and Chuck Starbird

Pledge of Allegiance was recited.

New Business:

I. Executive Session Pursuant 1 MRSA 405(6)(a)(1)(2)(3) Discussion or consideration of the employment, appointment, assignment, duties, promotion, demotion, compensation, evaluation, disciplining, resignation or dismissal of an individual or group of public officials, appointees or employees of the body or agency or the investigation or hearing of charges or complaints against a person or persons –

The Town Administrator stated Autumn Littlefield has requested open session. This meeting is being held to ratify the Fire Chief’s decision to terminate said employee. Meeting was held in open session. Chairman Cudworth asked the Fire Chief to present his evidence in regards to Autumn not responding to fire calls.

a. Chief presented evidence concerning his meetings with said employee regarding not responding to calls. According to his records he attended only 3 out of 154 calls for service in 2020. Since January 2021 there has been 56 calls and as of April 30, 2021 Autumn hasn’t responded to any.

b. Chairman Cudworth asked Autumn for her evidence regarding not responding to calls. Autumn stated that she had received a letter from the Chief stating she was not qualified to enter into burning buildings. Autumn didn’t have a copy of the letter but was able to produce a copy of the letter that was sent to another FD employee which stated the same information. Autumn show Chairman Cudworth the letter via phone document where it states she cannot take part in any fire ground activities. Chairman Cudworth stated that the letter says: until further notice Autumn is restricted to exterior support function work only.

c. Board of Selectmen deliberated.

d. Motion was made by William J. Mageary, Seconded by Michael J. Cote to uphold the Chief’s decision to terminate Autumn Littlefield based on FD rules & regulations and the requirement of membership. No further discussion. Motion carried. Chairman Cudworth stated that if the employee wants to appeal this decision, she may do so to the Fair Hearing Authority.

II. The Town Administrator stated Ryan Sabine has requested open session. This meeting is being held to ratify the Fire Chief’s decision to terminate said employee. Meeting was held in open session. Chairman Cudworth asked the Fire Chief to present his evidence in regards to Ryan not responding to fire calls.

b. Chairman Cudworth asked Ryan for his evidence regarding not responding to calls. Ryan stated that he was not going to drive from Sanford during a snowstorm to Shapleigh for a fire call. The Board asked Ryan and Fire Chief if they had any other evidence to present. Response from both was no.

c. Board of Selectmen deliberated.

d. Motion was made by William J. Mageary, Seconded by Michael J. Cote to uphold the Chief’s decision to terminate Ryan Sabine based on FD rules & regulations and the requirement of membership. No further discussion. Motion carried. Chairman Cudworth stated that if the employee wants to appeal this decision, he may do so to the Fair Hearing Authority

III. The Town Administrator stated Knathan Sabine has requested open session. This meeting is being held to ratify the Fire Chief’s decision to terminate said employee. Meeting was held in open session. Chairman Cudworth asked the Fire Chief to present his evidence in regards to Knathan not responding to fire calls.

b. Chairman Cudworth asked Knathan for his evidence regarding not responding to calls. Knathan had nothing to present at this time. Chairman Cudworth asked both the Fire Chief and Knathan Sabine if they had anything else to present. Response was no.

c. Board of Selectmen deliberated.

a. Motion was made by William J. Mageary, Seconded by Michael J. Cote to uphold the Chief’s decision to terminate Knathan Sabine based on FD rules & regulations and the requirement of membership. William J. Mageary mentioned that the FD Chief went over and above by allowing an additional 60 days after the letters had been issued to employee before making his decision to terminate. Motion carried. Chairman Cudworth stated that if the employee wants to appeal this decision, he may do so to the Fair Hearing Authority. At this time Michael Sabine asked what evidence would be presented to the Fair Hearing Authority. The Town Administrator stated the evidence that was presented tonight. M. Sabine stated that evidence presented tonight discussed more than not attending fire calls. M. Sabine was upset and became disruptive. M. Sabine also stated that after termination said employee is to be paid wages due to them. William J. Mageary stated those check requests have been approved at tonight’s meeting. M. Sabine left the building while yelling profanity.

Adjourn:

A motion was made by Michael J. Cote to adjourn at 5:37 pm; seconded by William J. Mageary.  Motion passed unanimously.
